Privacy Policy

This Privacy Policy describes how FactualIQ LLC (“FactualIQ,” “we,” “us,” or “our”) collects, uses, and protects your information when you access and use the Payapps application (“Payapps” or “the App”), the project, contract, and pay-application management platform powered by the FactualIQ Decision Engine.

1. Information We Collect

  • Account information — your name and email address. Payapps signs you in using Auth0 passwordless authentication, which sends a one-time code to your email address. We never receive or store your password.
  • Profile and permissions — your role within your organization (viewer, manager, admin, or superadmin) and your company affiliation.
  • Content you provide — the contracts, pay applications (including G702/G703 forms), lien waivers, insurance certificates, and other project documents you upload, along with the notes, status changes, and other information you enter.
  • Usage and analytics — information about how you use the App, including the pages and features you visit, the actions you take, and, where enabled, session-replay recordings. Analytics identifiers may include your email address, role, and company name.

2. How We Use Your Information

We use the information we collect only to:

  • Create and manage your account, authenticate you, and keep you signed in.
  • Enforce your organization’s roles and permissions across projects and documents.
  • Provide the App’s core service — store and process the documents you upload and produce the FactualIQ Decision Engine analyses, including contract signal reports, pay-application signal reports, the G703 tracker, contract checks, and the chat assistant.
  • Bill for services (project and pay-application fees, as configured by your organization).
  • Communicate with you about your account, important updates, and support.
  • Scan uploaded documents for malware, monitor performance and reliability, and keep the App secure.
  • Understand product usage and improve the App.

3. AI Processing

To generate the analyses, reports, and answers described above, the App transmits the documents you upload and the questions you ask to third-party AI model providers (Anthropic Claude models accessed through OpenRouter). We use these services solely to provide the App’s features. We do not use your content to train or improve the underlying AI models, and we select and configure the providers we use in line with their applicable data-handling terms.

AI outputs are generated from your documents and are intended to assist qualified construction and finance professionals. They are not a substitute for professional judgment (see the Terms of Service).

4. How We Share Your Information

We do not sell, rent, or trade your personal information. We may share information only in the following circumstances:

  • With service providers and subprocessors who help us operate the App — including Auth0 (authentication), OpenRouter and Anthropic (AI model access), Amazon Web Services (document storage and telemetry), Amplitude (product analytics and session replay), Arize Phoenix (LLM tracing), and ClamAV (malware scanning) — each bound by confidentiality obligations and using the information only as needed to provide its service.
  • Within your organization, according to the roles and permissions your organization has assigned.
  • When required by law, regulation, or valid legal process.
  • To protect the rights, property, or safety of our users or the public.

5. Data Storage and Security

We store project, contract, and pay-application data in Postgres, encrypted at rest with AES-256-GCM, and uploaded documents in AWS S3 with server-side encryption. Data is transmitted over encrypted (TLS) connections, and uploaded files are scanned for malware before they are stored. We apply reasonable technical and organizational measures to protect your information against unauthorized access, alteration, disclosure, or destruction. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

6. Data Retention

We retain your personal information only for as long as necessary to provide the App’s services and fulfill the purposes described in this policy, unless a longer period is required by law. You may request deletion of your data at any time (see Section 8). Content uploaded and processed on behalf of your organization is retained and deleted in accordance with your organization’s agreement with us (see Section 7).

7. Organizational Content

Content ingested, processed, or generated through the App on behalf of your organization is governed by the Master Services Agreement or other written agreement between your organization and us, which controls in the event of any conflict with this policy.

8. Your Rights and Choices

You have the right to:

  • Access the personal information we hold about you.
  • Request correction or deletion of your information by emailing support@factualiq.ai.
  • Stop using the App at any time. Your organization administers your access, roles, and permissions.

9. Children’s Privacy

The App is not intended for use by those under the age of 18, and we do not knowingly collect personal information from children.

10. Changes to This Policy

We may update this Privacy Policy from time to time. Any changes will be posted on this page with an updated “Last updated” date.
